The petition to review the verdict to repeal the Thirteenth Amendment to the Constitution, which introduced the caretaker government system, is on the agenda of the Supreme Court’s Appellate Division hearing on Sunday.

On December 1, the Appellate Division headed by Chief Justice Dr. Syed Refaat Ahmed set the review for hearing on January 19. Senior lawyers Zainul Abedin, Sharif Bhuiyan and lawyer Mohammad Shishir Monir were in favor of the petition in the court that day. Attorney General Md. Asaduzzaman was on the side of the state.

BNP Secretary General Mirza Fakhrul Islam Alamgir filed a review petition on October 16 against the verdict to annul the Thirteenth Amendment to the Constitution, which abolished the caretaker government system.

Earlier, Dr. Badiul Alam Majumder, editor of Sushasan-e-Nagorik-Sujon, filed a review petition on this issue. In addition, Professor Mia Golam Parwar, Secretary General of the party, filed a review petition on behalf of Bangladesh Jamaat-e-Islami. These review petitions were scheduled for hearing together.

The Thirteenth Amendment to the Constitution, which included the caretaker government system, was passed by the National Parliament in 1996. Three lawyers, including Advocate M. Salim Ullah, filed a writ petition in the High Court challenging the validity of this amendment. On May 10, 2011, the Appellate Division of the Supreme Court declared the Thirteenth Amendment to the Constitution, which introduced the caretaker government system, illegal and annulled it. After the announced verdict, the Fifteenth Amendment Act, which brought several issues including the abolition of the caretaker government system, was passed by the National Parliament on June 30, 2011. The gazette regarding this was published on July 3, 2011.

In addition, on December 17, a High Court Division Bench comprising Justice Farah Mahbub and Justice Debashish Roy Chowdhury declared Sections 20 and 21 of the Fifteenth Amendment Act regarding the abolition of the caretaker government system to be inconsistent with the Constitution and void.
